Joint Decree Defines Notaries' Fees for Acts Related to Law No. 41 of 2024

A joint decree signed on February 4, 2025, by the Minister of Justice and the Minister of Finance, has been published in the Official Journal of the Tunisian Republic. This decree defines the fees of notaries for acts related to Law No. 41 of 2024, which amends the Commercial Code.

According to the decree, a notary receives 60 dinars for each conciliation or settlement agreement, regardless of the number of checks involved, taking into account the taxes and fees provided for by the current legislation. In the event of travel to a prison for the drafting of these acts, a notary will receive travel expenses for each institution visited, at the expense of the applicants, who are jointly responsible for payment. This decision, which came into effect upon publication, aims to clarify and regulate notaries' fees within the framework of recent legislative reforms.
