Ministry of Commerce and Export Development Calls for Transparency in E-Commerce Transactions
The Ministry of Commerce and Export Development emphasizes the need for merchants promoting their products or services through websites, platforms, applications, and social media pages to inform consumers of the details of the offers being made. This includes providing transparent and accurate information before concluding transactions and at various stages of their execution, particularly regarding:
- Seller's Identity: commercial name, unique business identifier, address, and contact means.
- Product/Service Description: precise description of the product or service, price, warranty conditions, shipping costs, execution deadlines, and payment methods.
- Cancellation and Return/Exchange: conditions and modalities for purchases and returns or exchanges.
The Ministry also urges delivery companies to include various provisions related to the identity of parties involved in the commercial process (seller, delivery company, and consumer) on the order receipt, invoice, or delivery note, in addition to the delivery date of goods or service execution, exact designation, quantity, and price.
Consumer Rights and Responsibilities
The Ministry reminds them of their right to choose and check when making distance purchases through electronic commerce channels. They should avoid dealing with websites that do not provide the aforementioned data and are reminded of their right to request a documented invoice for the commercial transaction, as it is an essential and necessary means to preserve their compensation, return, and warranty rights when needed.
Economic Surveillance Services
The Ministry confirms that they are working to address practices that may harm the security and integrity of electronic commercial transactions and consumer rights, in accordance with the laws and regulations governing the sector.
